1. Legal Agreement
These Terms constitute a legally binding agreement under the laws of New Zealand between you (“User”) and Eliwa Project Controls Limited.
2. Platform Role (Very Important Legal Clause)
lists.co.nz acts solely as an intermediary platform.
We:
- DO NOT sell goods
- DO NOT guarantee listings
- DO NOT act as agent for users
3. Eligibility
You must:
- Be at least 18 years old
- Provide accurate information
- Have legal capacity under NZ law
4. Listings & Content
You grant us a non-exclusive worldwide license to display your content.
We reserve the right to:
- Remove listings
- Edit content
- Restrict visibility
5. Prohibited Use
You must not:
- Violate NZ law
- Engage in fraud or deception
- Post misleading advertisements (Fair Trading Act 1986)
- Use automated bots
6. Payments Disclaimer
We are NOT responsible for:
- Payment disputes
- Failed transactions
- Fraudulent transfers
7. Limitation of Liability
To the fullest extent permitted by New Zealand law:
We shall not be liable for:
- Loss of profit
- Indirect damages
- User disputes
8. Indemnity
You agree to indemnify and hold harmless the company against any claims arising from your use.
9. Governing Law
These terms are governed by the laws of New Zealand
